Gathering and Handlung Documentary Evidence.
1. The success of arson-for-profit investigations depends heavily on documentary evidence uncovered during the case. As indicated in the previous chapter business, financial and insurance records have proved to the important sources of documentary evidence during an investigation. Reviews of residential and commercial property insurance applications of several states show that many items of information are commonly requested. Additionally, insurance agents who assist the applicant in completing the information often witness the signing of the application prior to binding the policy, and can attest to this fact during sub sequent court litigation.
2. Following is a list of such common items. This sort of information is often scrutinized by insurance agents, adjusters, and underwriters, as well as fire and law enforcement investigators, while probing a suspicious or incendiary fire loss. During the application and underwriting phases of the insurance contract, the underlying assumption is that the insured has supplied valid and accurate information to the agent. Many times, only after a fire loss occurs does the application receive a rigorous analysis by insurance company representatives and low enforcement agencies investigating the loss.
3. Often in cases of arson, a fraudulent insurance claim is submitted to the adjuster, who must determine its validity. Furthermore, intentionally misrepresented facts may be concealed within the policy application and later indentified during an arson-for-profit investigation.
4. Concerning specific references within the insurance policy to misrepresentations, the first line of most contracts reads: This entire policy shall be void it, whether before or after a loss, the insured has willfully concealed or the subject thereof, or in the interest of the insured therein, or in case of any fraud or false swearing by the insured relating thereto. In brief, if the insurance application contains facts that have been misrepresented, the validity of claims can be questioned.
5. As stated earlier, many aspects of an arson-for-profit investigation are a matter of public record. Furthermore, news media personnel are often eager to turn over information that is material to the case in exchange for cooperation concerning news items of items of interest. Clippings from the news papers vaults often reveal past patterns of activity and save valuable research time. Carefully released statements concerning “public record”, information such as the cause and origin of the fire, execution of search warrants and arrests seem to satisfy most professional journalists. In summary, the use of an investigation plan will not insure – but will provide the best opportunity for a comprehensive probe into arson-for-profit cases. The give-and-take approach with the news media of public record information also promotes an outward impression of a professional investigation.
